Terms & Conditions

By accessing this website or placing a booking or order with Lusam Group of Companies ("Lusam Group", "we", "us", or "our"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services. These terms are governed by the laws of the Republic of Kenya.

Lusam Group provides: • Equipment Rental: Temporary hire of audio and visual equipment for events, subject to availability and approval. • Equipment Sales: Sale of audio and visual equipment on an outright purchase basis. • Sound Services: Professional Gospel sound engineering services for events and productions. We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice.

3.1 Confirmed Bookings: A booking is confirmed only upon receipt of written confirmation from Lusam Group and payment of the required deposit (minimum 50% of total rental cost). 3.2 Availability: All equipment is subject to availability. We will inform you as soon as possible if requested equipment is unavailable. 3.3 Deposit & Balance: The remaining balance must be paid in full before equipment is released or services commence. 3.4 Minimum Hire Period: The minimum hire period is one (1) day unless otherwise agreed in writing.

4.1 Condition: All equipment is provided in full working condition. You must inspect and confirm condition upon collection or delivery. 4.2 Care: You are responsible for the equipment while it is in your possession. All equipment must be used only for its intended purpose and by competent persons. 4.3 Loss or Damage: You are fully liable for any loss, theft, or damage to rented equipment beyond fair wear and tear. Replacement costs will be charged at current market value. 4.4 Return: Equipment must be returned by the agreed date and time in the same condition as received. Late returns will incur additional daily charges at the standard daily rate. 4.5 Non-Return: If equipment is not returned within 7 days of the agreed return date without explanation, we reserve the right to report the matter to law enforcement.

5.1 Accepted Payments: We accept M-Pesa, bank transfer, and cash. Payment details will be provided at the time of booking confirmation. 5.2 Pricing: All prices are in Kenya Shillings (KES) and are exclusive of VAT unless stated otherwise. We reserve the right to update prices; any changes will not affect confirmed bookings. 5.3 Invoices: VAT invoices will be issued upon request for confirmed bookings.

6.1 Cancellation by Client: • More than 7 days before the event: Full refund of deposit • 3–7 days before the event: 50% of deposit refunded • Less than 3 days before the event: No refund of deposit • After equipment has been released: No refund; full payment remains due 6.2 Cancellation by Lusam Group: In the unlikely event we must cancel (e.g., due to equipment damage or force majeure), we will provide a full refund of all amounts paid and will endeavour to find alternative arrangements. 6.3 Force Majeure: Neither party shall be liable for failure to perform due to events beyond reasonable control, including natural disasters, civil unrest, or government restrictions.

7.1 Limitation of Liability: To the maximum extent permitted by Kenyan law, Lusam Group's total liability for any claim arising from our services shall not exceed the amount paid by you for that specific booking or purchase. 7.2 No Liability for Consequential Loss: We are not liable for any indirect, incidental, or consequential loss, including loss of profit, business interruption, or reputational damage. 7.3 Client Indemnity: You agree to indemnify and hold Lusam Group harmless from any claims, losses, or damages arising from your misuse of our equipment or breach of these Terms.

8.1 Title: Ownership of purchased equipment transfers to the buyer only upon receipt of full payment. 8.2 Condition: Equipment sold is in the condition described on the listing. Second-hand or refurbished items are sold as described and may not carry a manufacturer warranty. 8.3 Returns: Sales are generally final. If equipment is materially different from its description, you may request a return within 3 days of collection, subject to our inspection and approval.

You agree not to: • Use this website for any unlawful purpose • Attempt to gain unauthorised access to any part of the system • Upload or transmit malicious code or harmful content • Scrape or copy data from the site without permission We reserve the right to restrict access to any user who violates these terms.

11.1 Negotiation: In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. 11.2 Mediation: If negotiation fails, disputes shall be referred to a mutually agreed mediator in Nairobi, Kenya. 11.3 Jurisdiction: These Terms are governed by the laws of Kenya. Any unresolved dispute shall be subject to the exclusive jurisdiction of the courts of Kenya.

We may update these Terms and Conditions at any time. The revised terms will be posted on this page with an updated date. Continued use of our services after any change constitutes your acceptance of the new terms. We recommend reviewing this page periodically.
